Blue Fever Referral Program Terms
Thank you for helping us grow the Blue Fever community! Everyone could use some support: your friend, a girl in your class, or someone on Insta. From time to time, Blue Fever may allow you to participate in one of its referral programs (“Referral Program”). Participating on a referral program is a great way to earn Blue Fever Flames (“Flames” or “Referral Rewards”) that you can use to redeem for promotional products listed on our Flame “Rewards Path” included in Blue Fever Rewards page.
Blue Fever, in its absolute discretion, reserves the right to cancel, change, suspend or modify any aspect of the Referral Program at any time and for any reason. If we make changes, we will post the amended Program Terms on our website and update the “Last Updated” date above. We may also attempt to notify you in other ways. Unless we say otherwise, the amended Program Terms will be effective immediately and your continued participation in the Referral Program after the amended terms are posted will confirm your acceptance of the changes. If you do not agree to the amended Program Terms, you must stop participating in the Referral Program.
If you do not agree to the entirety of the Program Terms, you are not authorized to participate in the Referral Program in any manner. You may not participate in the Referral Program where doing so would be prohibited by any applicable law, regulation, or professional code of conduct. Blue Fever further reserves the right to disqualify any Referrer at any time from participation in the Referral Program if you not comply with these Program Terms. Blue Fever’s failure to enforce any term of these Program Terms shall not constitute a waiver of that provision.
About the Referral Program
Referral Program Period: This Program will continue until terminated, suspended, modified, or converted to another rewards program by Blue Fever ("Program Period").
Eligibility: To participate in the Referral Program, you must sign up for Blue Fever using a mobile phone number during the time when the Referral Program has an active promotional offer that will allow you to earn Flames at the time a Qualified Referral is made (“Promotional Period”). You must be fully compliant with these Program Terms and must be 13 years of age or older. Individuals between the ages of 13 and 17 (or the legal age of majority in their state of residence), must obtain their parent’s or legal guardian’s consent prior to participation in the Referral Program. Employees, officers and directors, their immediate family members (spouse, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of Blue Fever or its affiliates are not eligible to participate in the Referral Program.
Referral Program Participation: Once you sign up for Blue Fever, go to the Blue Fever “Referral” page, enter your mobile phone number, and click on “Get Your Invite Link” to receive a personalized referral link. With your consent, we will also send a text message to the number provided with the personalized link. You can send this personalized referral link to your friends and family letting them know about Blue Fever. We will also provide a functionality through the “Referral” page on our website to allow you to send an invite to Blue Fever through email or social media sites such as Facebook, and Twitter. Please note the reward offers and redeemable products will change and may vary from time to time, depending on the current available promotions.
Qualified Referrals: You can earn Flames for each Qualified Referral. A “Qualified Referral” means that all of the following conditions are met:
You have the Referred User's consent to send them the personalized link to Blue Fever
The Referred User is a resident of the U.S. who is 13 years of age or older and not already a registered user of Blue Fever.
If your invitee follows the links in your invitation and signs up to Blue Fever using the referral link provided as a Qualified Referral, your Flame(s) will be automatically applied to your account, as applicable. Flames can only be awarded for Qualified Referrals completed during the Referral Program Period. Maximum of one (1) Flame issued per Qualified Referral. The Referred Individual and the Referrer cannot be the same person (for example, by using a different email address). If someone you referred made his or her qualifying purchase using your personal referral link and you didn’t receive store credit, your referral might have been flagged as suspicious. Just send us an email at email@example.com and we’ll look into it.
Restrictions: Referrers must respect the spirit of the Referral Program by only referring real individuals with whom you have a personal relationship and who the Referrer believes in good faith may wish to participate in the Blue Fever Referral Program. You are solely responsible for ensuring you are emailing referrals to friends and family who have provided you with permission to send them marketing communications. You must comply with all laws and marketing regulations, which may include the laws where your friends or family members live. Remember, no one likes spam – so make sure you invite only those individuals who have given you permission!
Any distribution of your referral link that could constitute unsolicited commercial email, text, or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from Blue Fever’s Referral Program.
Earning Flames: You will earn one Flame for each Qualified Referral made. From time to time, we may offer special opportunities to earn additional Flames during a Referral Promotional Period, including through limited time refer-a-friend bonus programs or by completing surveys. Additional Flames earned during the Referral Promotional Periods are subject to the terms and conditions of that offer.
You can earn up to 100 Flames, which will allow you to redeem all the available rewards in the Rewards Path. Please allow up to ten (10) business days from the date the Referred User completed registering to Blue Fever through your personalized link for your Flames to be issued. Blue Fever may, in its sole discretion, withhold Flames for investigations, or refuse to process any transaction Blue Fever deems to be fraudulent, suspicious, in violation of these Program Terms, or believes will impose potential liability on Blue Fever, its subsidiaries, affiliates, or any of their respective officers, directors, employees, representative and agent, in each the Blue Fever’s sole discretion. All decisions of the Blue Fever are final and binding.
You can check how many Flames you have earned by going to the referral page, entering your phone number and clicking on “Get Your Invite Link.”
Flames Redemption: Flames will be automatically redeemed based on the Blue Fever Rewards Path. The more Flames you accrue, the more value you can receive! Your rewards will be automatically redeemed based on the Rewards Path promotional product you unlock. You will continue to accrue Flames as you refer more friends! Blue Fever will send you a text message every time you unlock a reward with more information on how to redeem your reward. For physical products, we may need your shipping address so Blue Fever can mail you your earned reward. Please allow up to 10 business days from the date you unlock a reward for Blue Fever to contact you via text message with more information on how to redeem your reward.
Restrictions: Flames are issued for promotional purposes only and have no cash value. Flames are not transferable. No substitution or cash redemption of any Flames, or portion thereof, is permitted. Flames are redeemable only in connection with a promotional product included in the Blue Fever Rewards Path. Flames may not be sold, transferred (by operation of law or otherwise) or assigned to or shared with any other individual for any commercial purpose. You are responsible for any federal, state or local taxes applicable to your participation in the Referral Program.
You agree that you will not attempt to mislead anyone in connection with the Referral Program, either by affirmative representation, implication, or omission. You further agree that you will not “spam” anyone with invitations to join our community, and that you at all times will remain compliant with CAN-SPAM and other applicable laws. The following specific activities are prohibited:
Send mass emails or messages to people you do not personally know to solicit invitees;
Use scripts, programed or automatic systems, bots, or dialers through any channel to distribute, post, or otherwise share your invitation;
Duplicate, sell, or transfer your invitation in any manner or make it available to the general public, such as on event or venue pages without express permission from the owner;
Make misleading claims about Blue Fever, use offensive/abusive content, create fake websites/webpages/social media profiles/apps, misrepresent your connection to Blue Fever, or otherwise make any false or misleading statements to get an invitee to use your invitation; or
Use your referral link in any manner that violates the law or the rights of Blue Fever or anyone else.
If you violate any of these restrictions, Blue Fever may, in its discretion, remove your eligibility to participate in the Referral Program, and/or deny you any Flames earned in violation or suspected violation of these restrictions.
Flames Expiration: Any earned Flames will expire after 12 months of Referral Program inactivity (e.g. no referrals are made which means you don’t earn any Flames).
Communications with Blue Fever: By joining the Referral Program, you (or if you are a minor, your parent or legal guardian) agree to receive communications regarding the Referral Program from Blue Fever. In addition, you will receive marketing communications with offers, events, and other promotions from Blue Fever – don’t worry, you can unsubscribe from marketing communications at any time!
Your Right to Cancellation: You can cancel your Referral Program membership at any time. Upon cancellation, any unused Flames accrued in your account will automatically expire and cannot be redeemed. To cancel your membership, you must email us at firstname.lastname@example.org.
Right to Close Accounts: Blue Fever reserves the right to close the account(s) of any Referrer and/or Referred User and to request proper payment if the Referrer and/or Referred User attempts to use the Blue Fever Referral Program in a questionable manner or breaches any of these Program Terms & Conditions or is in violation of any law, statute or governmental regulation.
Right to Suspend, Cancel Program or Change Program Terms: Blue Fever reserves the right to modify, amend, suspend or terminate the Referral Program at any time and for any reason at its sole discretion. Continued participation in the Referral Program after any update will mean that you have agreed to the update. This right, however, will not affect the expiration date for any reward that has been already provided or earned, in accordance with these Program Terms.
